The controversy sparked by German President Frank-Walter Steinmeier\u2019s description of the Iran war as a \u201cviolation of international law\u201d continues<\/a><\/span> to reverberate.<\/p>\n

The German government led by Chancellor Friedrich Merz and the European Commission under Ursula von der Leyen have persisted in encouraging Berlin and Brussels\u2019 support for the US-Israel position.<\/p>\n

The German government has so far refrained from formally classifying the attack as a breach of international law.<\/p>\n

Von der Leyen has continued to articulate similar views. Speaking recently on international law, she argued that \u201cEurope should no longer see itself as the guardian of the old world order.\u201d<\/p>\n

Steinmeier, meanwhile, faced sharp criticism for his remarks, including a forceful response from the CDU\/CSU parliamentary group leader in the Bundestag.<\/p>\n

Steinmeier condemns the war<\/strong><\/p>\n

Steinmeier, who is due to leave office next year, issued pointed criticism of both the German government and the European Commission\u2019s stance.<\/p>\n

At the same time, as noted by German Foreign Policy, Steinmeier himself bore shared responsibility for Germany\u2019s participation in the March 1999 attack on Yugoslavia, having served at the time as Minister of State in the Federal Chancellery.<\/p>\n

He warned that \u201cmajor powers\u201d might be able to survive, and even profit in the short term, in \u201ca world without rules.\u201d<\/p>\n

Arguing that neither Germany nor the EU could be counted among such powers, Steinmeier stressed that an international legal order with fixed rules governing the use of force is \u201cvital for the survival of those who cannot count themselves among the major powers.\u201d<\/p>\n

He added that there was \u201cno doubt\u201d the war against Iran violated international law, and noted that the German government continued to claim it was still assessing the legality of the intervention.<\/p>\n

\u201cNot calling a violation of international law what it is does not make our foreign policy more convincing,\u201d Steinmeier said.<\/p>\n

CDU\/CSU backlash against the president<\/strong><\/p>\n

Steinmeier\u2019s remarks prompted a strong political backlash<\/a><\/span>.<\/p>\n

Jens Spahn, leader of the CDU\/CSU parliamentary group in the Bundestag, stated that assessing actions \u201cunder international law\u201d remained the responsibility of the federal government, \u201cas in other cases.\u201d<\/p>\n

\u201cI expect officials and senior representatives of the Federal Republic to await this assessment and respect it,\u201d Spahn said, calling on Steinmeier to exercise restraint.<\/p>\n

Alexander Hoffmann, the CSU regional group leader, echoed similar remarks on the sidelines of a parliamentary meeting.<\/p>\n

\u201cFor us, international law has the highest priority. But it must not become a shield for terrorist regimes,\u201d Hoffmann said.<\/p>\n

Spiegel: AfD and Araghchi back Steinmeier<\/strong><\/p>\n

Following Steinmeier\u2019s comments, German media outlets reacted swiftly.<\/p>\n

Der Spiegel drew attention with a report<\/a><\/span> headlined: \u201cSteinmeier earns praise from Tehran and AfD for comments on the Iran war.\u201d<\/p>\n

The report cited Iranian Foreign Minister Abbas Araghchi, who said on X that Steinmeier deserved recognition for condemning violations against Iranians.<\/p>\n

The far-right Alternative for Germany (AfD), which frequently criticizes the president, also expressed support.<\/p>\n

Co-leader Tino Chrupalla said: \u201cHe was right on this issue, which is rare for the Federal President. The attack on Ukraine violated international law. The attack on Iran does as well.\u201d<\/p>\n

Deutsche Welle, reporting on the president\u2019s post on X, added a note<\/a><\/span> emphasizing that \u201cthe role of the German president is largely ceremonial and does not reflect government policy.\u201d<\/p>\n

Berlin avoids condemning US-Israel<\/strong><\/p>\n

Neither the German government nor the European Commission has so far formally described the US-Israel attack on Iran as a violation of international law.<\/p>\n

In one of his initial responses, Chancellor Merz stated that \u201cclassifications under international law\u201d would have \u201crelatively limited impact.\u201d<\/p>\n

He added that \u201cthis is not the time to lecture our partners and allies,\u201d while also criticizing any reluctance to defend core interests with military force if necessary.<\/p>\n

Commentary by the German Council on Foreign Relations interpreted the latter remark as amounting to \u201cde facto full political support\u201d for the Iran war, which has been justified as a \u201cpreemptive strike.\u201d<\/p>\n

Merz\u2019s demand that Iran must \u201cimmediately cease its indiscriminate attacks\u201d was also seen as implying a departure from previously established norms of international law.<\/p>\n

Von der Leyen: EU no longer guardian of the old order<\/strong><\/p>\n

Echoing Merz, European Commission President von der Leyen also spoke on March 9.<\/p>\n

Addressing the EU Ambassadors Conference, she said there were differing views on whether the war against Iran was \u201ca matter of choice or necessity.\u201d<\/p>\n

She argued that this debate \u201cpartly misses the point,\u201d insisting that Europe must \u201csimply take reality into account.\u201d<\/p>\n

Referring explicitly to international law, von der Leyen stated that \u201cEurope should no longer be the guardian of the old world order,\u201d describing it as part of a past that \u201cwill not return.\u201d<\/p>\n

In apparent contradiction, she also maintained that the EU would \u201calways defend the rules-based order,\u201d before adding that it could \u201cno longer rely on this alone\u201d to safeguard its interests.<\/p>\n

Calling for a \u201cmore realistic and interest-driven foreign policy,\u201d von der Leyen faced sharp criticism in the European Parliament shortly afterward.<\/p>\n

ECFR criticism: Failure to condemn Iran attack undermines Ukraine stance<\/strong><\/p>\n

The positions taken by Merz and von der Leyen have drawn strong criticism from foreign policy experts at both national and international levels.<\/p>\n

Beyond fundamental objections, tactical arguments have also emerged. The European Council on Foreign Relations warned that if Berlin and the EU fail to uphold international law in the Iran conflict, they will struggle to invoke it credibly in the context of the war in Ukraine.<\/p>\n

The DGAP further argued that Berlin should not support \u201ca war of aggression that runs counter to German interests in multiple respects,\u201d citing risks such as an energy crisis, supply chain disruptions, and a potential wave of refugees linked to the Iran war.<\/p>\n

According to DGAP, Germany remains \u201ca marginal actor in the Iran war,\u201d and therefore has no compelling reason to support the intervention.<\/p>\n

The think tank called for Berlin to initiate a \u201ccourse correction,\u201d arguing that Germany can only restore credibility and exert influence if it leaves \u201cno doubt\u201d that international law will remain the \u201cfoundation and guiding principle\u201d of its foreign policy.<\/p>\n
