This legislation will dismantle the decentralized intelligence architecture the country has maintained since the Second World War, paving the way for the establishment of the National Intelligence Council and the National Intelligence Bureau. The House of Councillors began deliberating the legislation on Friday, May 8; given the backing it has secured from the opposition as well as the ruling coalition, its ratification appears highly probable.<\/p>\n<p>Why, then, has Japan been compelled to take such a step, however belatedly?<\/p>\n<p><strong>Eighty Years in the Shadow of the Tokk\u014d<\/strong><\/p>\n<p>A concrete historical rationale underlies Japan&#8217;s delayed enactment of this reform. In the pre-war era, the Tokk\u014d, known as the &#8220;Thought Police,&#8221; surveilled and crushed communists, trade unionists, and all manner of dissident civic movements for decades following its inception. By 1936, the agency had arrested over 59,000 individuals, imprisoned thousands, and coerced detainees into signing confessions declaring themselves purged of their &#8220;dangerous thoughts.&#8221; Meanwhile, the military police unit, the Kempeitai, established a regime of terror both within Japan and across its occupied territories. The Allied occupation completely abolished these structures in 1945; subsequently, Article 9 of the ensuing 1947 Constitution barred Japan from establishing militaristic apparatuses at the constitutional level.<\/p>\n<p>This historical rupture engendered an enduring reflex in Japanese politics. For decades, the prospect of establishing a centralized, autonomous intelligence service akin to the CIA or MI6 was perceived as a &#8220;return to pre-war darkness.&#8221; Rather than engaging in a political reckoning with this perception, successive governments partitioned intelligence functions across five separate ministries. The Public Security Intelligence Agency, operating under the Ministry of Justice, tracked domestic threats; the Ministry of Defense&#8217;s Defense Intelligence Headquarters gathered signals intelligence; and the Ministry of Foreign Affairs monitored diplomatic channels. Coordination, meanwhile, remained largely confined to paper.<\/p>\n<p>The greatest vulnerability of this fragmented structure was the reluctance of these institutions to share their collected intelligence with one another. The Cabinet Intelligence and Research Office (CIRO), theoretically responsible for coordination, lacked any statutory authority to compel powerful ministries to share data. Regarding foreign intelligence, it remained incapable of conducting operations independent of Washington.<\/p>\n<p><strong>Takaichi\u2019s &#8220;Strong Japan&#8221; Gambit<\/strong><\/p>\n<p>It was both the regional threat environment and the political landscape that ultimately altered the equation. State-sponsored Chinese cyber groups, such as MirrorFace and Salt Typhoon, intensified their attacks against Japanese defense contractors and telecommunications infrastructure. North Korea persisted with its ballistic missile tests. Russia, meanwhile, did not abandon its revisionist policies.<\/p>\n<p>Amidst this backdrop, Prime Minister Sanae Takaichi assumed office in October 2025. In January 2026, she dissolved the House of Representatives, steering the country toward snap elections; in the February polls, the coalition led by the Liberal Democratic Party (LDP) secured a two-thirds parliamentary majority. This overwhelming mandate provided Takaichi with the leverage to pass sensitive security legislation. The intelligence bill, introduced in April 2026, garnered votes not only from the LDP and its ally, the Japan Innovation Party, but also from the opposition Centrist Reform Alliance and the Democratic Party for the People.<\/p>\n<p><strong>A Two-Pillared Architecture: The Council and the Bureau<\/strong><\/p>\n<p>The legislation envisions two primary bodies. The National Intelligence Council (NIC) will serve as the policymaking organ, chaired directly by the Prime Minister and comprising 11 senior cabinet members. The Council will chart the strategic course in domains such as foreign espionage, counterterrorism, economic security, and information manipulation.<\/p>\n<p>The National Intelligence Bureau (NIB), conversely, represents an expanded and restructured iteration of the existing Cabinet Intelligence and Research Office (CIRO). The Bureau&#8217;s most critical innovation lies here: it will possess the statutory authority to mandate data sharing from intelligence agencies housed across various ministries. This prerogative stands out as the key to overcoming decades of institutional siloing. Furthermore, the Director-General appointed to lead the Bureau\u2014previously holding the rank of an administrative vice-minister\u2014will be elevated to the status of a political appointee under the new law, positioned on an equal protocol footing with the head of the National Security Secretariat (NSS).<\/p>\n<p><strong>Analogues for the New Organization<\/strong><\/p>\n<p>The new bureau is decidedly not a &#8220;Japanese CIA.&#8221; While the comparison may appear compelling, it is structurally misleading. The CIA and MI6 are agencies that conduct clandestine operations abroad, recruit assets, and execute covert interventions. The new National Intelligence Bureau, by contrast, is a coordination and analysis center far more analogous to Australia&#8217;s Office of National Intelligence (ONI) or the United States&#8217; Office of the Director of National Intelligence (DNI).<\/p>\n<p>For Japan to acquire a genuine foreign operational capacity, the establishment of a separate Foreign Intelligence Agency is slated for 2027. Academics emphasize that this institutional separation is imperative, noting that housing the agency conducting the analysis and the agency gathering the data under the same roof would engender cognitive biases.<\/p>\n<p><strong>Concerns Over Strategic Lands and Penetration Activities in Japan<\/strong><\/p>\n<p>It is increasingly openly articulated that the new agency responds not solely to external threats, but also to a domestic vulnerability. In recent years, it has been documented that Chinese-linked corporations and Chinese nationals have purchased land in close proximity to military bases, radar stations, and strategic infrastructure in Japan. Tokyo enacted the Land Use Regulation Act in 2022 to address this matter; however, the legislation drew intense criticism for its weak enforcement mechanisms and ultimately proved ineffective. According to many Japanese security analysts, the existing fragmented intelligence apparatus was inherently ill-equipped to monitor such activities in a cohesive manner; data siloing among institutions obscured the broader picture.<\/p>\n<p><strong>Civil Liberties Concerns and the Supplementary Decree<\/strong><\/p>\n<p>The most contentious dimension of the reform emerges precisely at this juncture. Certain opposition lawmakers noted that the legislation, operating under the guise of &#8220;national security,&#8221; harbors the risk of profiling ordinary citizens, journalists, and anti-government protesters. In an effort to mitigate these concerns, the ruling bloc adopted a supplementary decree accompanying the law. The decree pledges that the new apparatus will not &#8220;collect intelligence capable of conferring an advantage or disadvantage upon specific political parties.&#8221; Although legal scholars pointed out that this decree lacks judicial enforceability and amounts to little more than a declaration of goodwill, opposition backing was ultimately secured through this formula.<\/p>\n<p><strong>The Sixth Eye of the Five Eyes Alliance?<\/strong><\/p>\n<p>Underlying this reform is Japan&#8217;s quest for deeper integration with Western intelligence networks. The United States had long been exerting pressure on Japan to institute intelligence reforms. Authorities publicly disclosed at the Tokyo Technical Partnership Forum in February 2026 that the Australian artificial intelligence firm Fivecast was providing analytical technology to counter foreign information manipulation.<\/p>\n<p>The most formidable obstacle to Japan&#8217;s integration into the Five Eyes alliance is the reservations held by Western allies regarding the country&#8217;s capacity to safeguard top-secret intelligence. In this regard, the establishment of the National Intelligence Bureau is not a culmination; it is the inception of a long-term process aimed at earning the trust of the West.<\/p>\n<p>Very soon, Japan will formally relegate its eighty-year legacy of decentralized intelligence to the past.
